Job Description

A human rights organisation in Harare is seeking a qualified consultant for a full-time assignment focused on Strategic Lawsuits Against Public Participation in Zimbabwe. The selected professional will conduct rigorous legal research to produce an analytical publication examining how such lawsuits impact environmental and climate justice, natural resource governance, and environmental human rights defenders.

The role involves analyzing domestic legislation, case law, and potential abuses of prosecutorial power, alongside regional and international human rights standards. The resulting publication aims to support strategic litigation, inform advocacy efforts, and identify ways to strengthen legal practitioner and judicial capabilities in addressing judicial harassment.

Deliverables for this engagement include an inception report with a proposed publication framework, a comprehensive draft manuscript, and a finalized publication ready for dissemination. The consultant will work under the guidance of the commissioning organisation, ensuring that all findings rely on verifiable court records and credible evidence without the use of generative artificial intelligence tools.

Responsibilities

  • Examine the core concepts and characteristics of SLAPPs as instruments of intimidation and judicial harassment regarding environmental protection and climate justice
  • Analyze Zimbabwe's constitutional, legislative, and institutional frameworks related to freedom of expression, public participation, and environmental rights
  • Conduct a critical review of Zimbabwean case studies, public interest litigation, and potential misuses of criminal proceedings
  • Evaluate African regional and international human rights standards and comparative legal approaches
  • Assess the consequences of legal intimidation on access to justice, judicial independence, and environmental advocacy
  • Identify knowledge and capability gaps among judicial officers and legal practitioners in recognizing and responding to SLAPPs
  • Formulate practical, evidence-based recommendations for the judiciary, policymakers, legal practitioners, and civil society
  • Deliver an inception report, a detailed draft publication, and a final professionally written publication in Microsoft Word format

Requirements

  • Advanced university degree in Law, with a preference for specializations in Environmental Law, Human Rights Law, or Constitutional Law
  • Substantial professional experience and demonstrable expertise in environmental and climate justice, human rights law, or public interest litigation
  • Strong command of Zimbabwean constitutional and environmental law, jurisprudence, and relevant regional and international frameworks
  • Proven background in conducting legal research and authoring high-quality analytical publications, policy papers, or scholarly legal writing
  • Thorough understanding of the practical and legal challenges faced by environmental human rights defenders

Qualifications

  • Familiarity with African regional and international human rights standards and comparative jurisprudence concerning SLAPPs
