The company offers a remote Privacy Counsel position within a rapidly scaling global privacy program that covers e-commerce, advertising, health, and artificial intelligence product lines.

This role suits a legal professional who can embed privacy into operational design and deliver practical, business-focused guidance to cross-functional teams including engineering, product, data science, advertising, and business development. The position is part of Instacart's Flex First remote work model, allowing employees to choose their preferred workspace while participating in periodic in-person gatherings.

During the first year, the privacy counsel will track global data protection developments, evaluate new product initiatives for compliance, structure data use frameworks for advertising, and govern data sharing agreements with partners. The successful candidate will also refine program operations by supporting privacy reviews, assessments, and internal training materials.

Responsibilities

  • Monitor global privacy and data protection developments to translate enforcement trends into actionable stakeholder guidance
  • Review new product and business initiatives across e-commerce, advertising, health, and AI lines to embed compliant design from inception
  • Oversee advertising data practices, audience targeting, measurement, and consent frameworks while restricting sensitive data usage
  • Assess data sharing agreements with retail partners, vendors, subsidiaries, and advertisers alongside appropriate data protection addendums and transfer mechanisms
  • Strengthen internal privacy operations by supporting assessments, intake procedures, documentation, and organization-wide training resources

Requirements

  • Hold a Juris Doctor degree from a top-tier law school and maintain active membership in at least one U.S. state bar, including California bar admission or eligibility for in-house registration
  • Bring six or more years of dedicated privacy and data protection experience gained at a law firm, in-house, or a combination of both
  • Possess deep working knowledge of the CCPA, GDPR, HIPAA, and emerging U.S. state privacy and health data legislation
  • Demonstrate past advisory experience concerning adtech, consumer data use, and data sharing within retail, e-commerce, or platform settings
  • Exhibit the ability to communicate complex legal mandates as practical recommendations for non-legal partners

Qualifications

  • Prior experience with artificial intelligence governance and privacy-by-design principles within machine learning and AI product creation
  • Demonstrated background in AdTech
